選挙の出口調査は一つの指針です。統計学で、あらかじめ、調査をすれば、どの候補が分かる、ような仕組みで、これは、びっくりするけれども、開票と同時に、分かるケースも、多くある。

私は、よく引越しをしたから、投票場も違うことが、多くあります。それでも、不思議なことに、2回も、出口調査をしている担当の人に声をかけられたことが、あります。どうやって、このように選ばれるのか、分からないけれども、不思議な感触に襲われます。

そんな、私は、いつも言う言葉は、「言えません」です。

これは、家族にも、話しては、いけない事項だと私は、両親から、教わったので、決して、口外しない。

日本国憲法にも、第32条にも、何人も、自己に不利益な供述を強要されない。とある。強制、拷問や脅迫によってもこれは、無効なのです。これは、供述の不強要、自白の証拠能力の事項です。

しかし、このように、選挙で、出口調査で、統計が取れるほど、人々は、投票した人の名前を調査員と言えども、気軽に、言うなんて、私には、考えられられない。

もっと、自分の権利と義務を知ることが、非常に大切です。いつも、選挙の投票結果をテレビで、レポートをする場面に遭遇すると、私は、もっと、国民は、その権利を知る、ことが、大切だと、感じることが多い。

日本の教育は、義務は、教えるが、権利については、あまり教えてくれない。

税制なんて、税務署に尋ねても、必要なことしか答えない。

だから、本当に、知らない、ってことは、権利を履行していないから、これは、非常に、損をしている、と感じることが、この頃、多くなった。

逮捕された人が、DNA鑑定と供述で、有罪とされたこともあった。しかし、この頃の、精密なDNA鑑定で、これは、犯人ではないと、確定した事例もある。

やはり、この憲法32条は、別名「黙秘権」とされるが、もっと、一般国民は、行使するべきだと、感じる。

随分前に、国会議員が、賄賂について、国会尋問があったけれども、「記憶にございません。」と繰り返すばかりで、何もそれ以上、問題に問われなかった。国民の中で、「記憶にございません。」という、言葉が、流行したほどで、それは、とても、有名な言葉になりました。

だから、国会議員に色んな疑惑があっても、これは、通用しないから、ゴシップ記事程度にしかならない。そんな感じで、この権利を知らないと、多くのことが、損をするので、もっと、国民の権利を知ることが、非常に大切だと、感じます。

国民の権利。これをもっと、勉強しよう。選挙出口調査の結果で、選挙結果が決まる、その瞬間をいつも見るたびに、私は、がっかりしています。今回は、国民の権利、「黙秘権」について、書いてみました。

Article 32 of the Japanese Constitution states that no person shall be compelled to make a statement against himself. This is invalid even through coercion, torture, or threats. This is a matter of non-coercion of statements and the admissibility of confessions as evidence.

However, I cannot imagine that people would so readily give the names of those they voted for, even to poll workers, in an election like this, where statistics can be collected through exit polls.

It is very important to know more about your rights and obligations. Whenever I see election results being reported on television, I often feel that it is important for citizens to know more about their rights.

In Japanese education, we learn about obligations, but not much about rights.

When you ask the tax office about the tax system, they only tell you what you need to know.

So, I have come to feel more and more recently that not knowing means that you are not fulfilling your rights, and that you are missing out a lot.

There have been cases where arrested people were found guilty based on DNA testing and statements. However, there have been cases where precise DNA testing has confirmed that the person was not the culprit.

Article 32 of the Constitution is also known as the "right to remain silent," but I feel that ordinary citizens should exercise it more.

A long time ago, a Diet member was questioned in the Diet about bribery, but he just kept repeating "I don't remember," and no further questions were asked. The phrase "I don't remember" became so popular among the public that it became a very famous phrase.

So even if there are various suspicions about Diet members, this doesn't work, so it only becomes a gossip article. In that sense, if you don't know about this right, you will lose a lot, so I feel that it is very important to know more about the rights of the people.
